Vacation rentals: the owner’s obligations

Even in the absence of specific regulation of the rental, a number of obligations are imposed on the owner of the rented accommodation.

State description of mandatory site

The landlord must give you, if you so request it, a description of the premises. The standard model is annexed to the Decree No. 25-305 of 16 May 1967. This does not commit you to anything.

You must find the following information:

- Address the housing and its environment: distance to the beach, downtown, shops, railway station;
- Its possible classification, with the number of stars;
- Renting is a home, apartment or studio;
- Its size, number of rooms and beds;
- Description of furniture and household equipment: washing machine, dryer, TV … ;
- The presence or absence of a balcony, garden, garage, swimming pool … specifying whether they are private or shared;
- The conditions of rent reserved period, price, deposit the rentals, the amount of charges … ;
- Any nuisances: noise associated with the proximity of a railway or an airport, odors from the nearby factory or raising pigs the farmer neighbor …

Warning! If the description of the lease is classified incorrectly, the owner can be fined up to € 3 750, and up to € 7,500 for each subsequent offense.

You can also sue for deceptive trade practice. The owner will incur up to € 37 500 fine and / or 2 years imprisonment. If you can prove harm, it must pay damages.

Pool safety

Owners of vacation rentals equipped with a private swimming pool have obligations. If the basin is fully or partially buried, they should equip it with a standardized system of protection (Code of Construction and Housing, ss. L.128-1 et seq.)

4 safety devices are officially registered:

- A protective barrier (NF P90-306);
- A cover closing the basin (NF P90-308);
- Enclosed shelter (NF P90-309);
- An audible alarm (NF P90-307).

Standards are available from the French Association for Standardization (AFNOR). 11 avenue Francis de Pressensé, 93571 Saint-Denis-La Plaine Cedex.

If the owner does not fit the pool of one of these safety systems, he incurs a fine of up to € 45 000. Moreover, he exposes himself to criminal sanctions (manslaughter, endangering others …).
